Land Dispute: Kano farmers jubilate as court rules in favour

In his ruling, Justice Lawan Wada-Mahmoud, ordered that the 238 farmers will be the owners of the land for 99 years.

A Kano State High Court on Tuesday declared that 238 farmers in Katarkawa Warawa Local Government of Kano State the are the rightful owners of a parcel of land.

The suit filed by Alhaji Adamu Mohammad on behalf of 237 Katarkawa farmers is seeking the court to declare that they are the rightful owners of the 1, 014 hectares of land situated in Katarkawa Warawa Local Government.

Supreme reports that the suit was filed in 2016 by the plaintiffs.

In his ruling, Justice Lawan Wada-Mahmoud, ordered that the 238 farmers will be the owners of the land for 99 years.

The judge held the plaintiffs have proved their case in their statement of claim and exhibit.

"Warawa Local Government has no power to reclaim the land after it has already transferred possession to National Agricultural Development Agency(NALDA) under the Federal Ministry of Agriculture.

"By this ruling, the Warawa local government should desist from trespassing and allocating the 1, 014 hectares allocated to the farmers.

" The allocation letters given to the farmers is still valid and legal," the judge held.

Earlier, Council to the plaintiffs, Mr Abba Shu'aibu, prayed the court to declare that his clients are entitled to peaceful and quiet possession of their individual farmlands in Katarkawa.

Supreme reports that the plaintiffs presented five witness and 102 exhibits.

Counsel to the respondents, Mr Murtala Shehu, presented five witness and four exhibits.
